Always Listen To Your Doctor During A Personal Injury Case

Everett Cook

When you are injured and are considering filing a personal injury claim, one of the most important steps you'll want to take is to follow the advice of your doctor. Doctors are qualified experts who can give the best advice on how you can recover from your injuries. Also, failure to follow your doctor's advice can affect your claim and make your personal injury attorney's job much harder.

Documentation

After following the instructions of your doctor, you will have medical records that can then be used to support your case. You will be able to use these medical records to seek compensation from the defendant or her insurance provider. The medical documents explain the following:

  • Your health
  • Your recovery
  • Your treatment plan
  • Your reoccurring problems

When you are questioned about your claim, the medical documents serve as your most important tool when fighting against claims that you are faking or exaggerating your injuries. However, if you do not follow your doctor's instructions and your condition becomes worse, this will become apparent in your medical records. The courts may question why you didn't follow the instructions of your doctor, and you may be considered comparatively at fault for your injuries.

Also, if you do not seek immediate treatment for your injuries, the insurance adjuster might argue that you were never really injured. However, with the right evidence, good medical records, and the right personal injury attorney, the adjuster may have a difficult time denying your claim. If you are forced to take your case to court, you will be much more likely to win it.

Don't Put Your Health in Jeopardy

You may be concerned about whether you can afford your medical treatments. However, there is usually a way to pay for your expensive treatments until you can be reimbursed. In some cases, your personal injury attorney might even pay for your medical bills until you are able to reimburse the attorney after you receive a settlement.

Following your doctor's instructions will improve your long-term outcome. The last thing you want is to have your case thrown out because you did not follow your doctor's instructions only to then be left with more severe medical problems that you cannot afford to pay for. For example, if you suffer a head injury, there are brain training exercises that must be performed early on that can reduce the cognitive problems you may face. With the expertise of your doctor and your personal injury attorney, you'll be more likely to have a better outcome.

About Me
Auto Accident Law 101

After being involved in a serious auto accident with a drunk driver, I struggled heavily with getting the driver's insurance company to open a claim. When the insurance company started pushing back, I knew I needed to do something. I spent a lot of time digging through the laws surrounding auto accident claims so that I knew what my legal rights were. I even talked with an auto accident attorney. I created this site to teach others about what I learned, including my court experience. I hope it helps you to determine how you should proceed with your auto accident case.
